General Terms and Conditions Definitions

In these Terms and Conditions, the following definitions apply:

• Contractor: Wall and Ceiling Expertise, located at Laarderhoogtweg 25, 1101 EB Amsterdam (postal address, not a visiting address), registered with the Chamber of Commerce under number 78580463;
• Client: the natural or legal person who has commissioned the Contractor to perform work;
• Work: the work performed by the Contractor within the framework of the Client’s commission.

Applicability

These General Terms and Conditions apply to all agreements between Client and Contractor.

Quotes

All quotes from the Contractor are non-binding and valid for a period of 30 days, unless otherwise stated.

Execution of the commission

The Contractor will execute the commission to the best of their knowledge and ability and will exercise the care that may be expected from a skilled contractor.

Liability

• The Contractor is not liable for any direct or indirect damage, including consequential damage, arising from any shortcoming in the execution of the commission.
• The Contractor’s liability is in all cases limited to the amount paid out by the Contractor’s liability insurance in the relevant case. If no payout occurs, liability is limited to the invoice amount of the relevant commission.

Payment

• Payment must be made within 14 days of the invoice date, unless otherwise agreed.
• In case of late payment, the Client is automatically in default and owes statutory interest.
• All judicial and extrajudicial collection costs are at the Client’s expense.

Retention of title

All delivered goods remain the property of the Contractor until the Client has fully met their payment obligations.

Disputes and applicable law

• Dutch law applies to all agreements between Client and Contractor.
• Disputes are exclusively submitted to the competent court in the district where the Contractor is located, in Amsterdam.
